These Consumer Terms and Conditions of Sale (the "Terms") govern purchases by individual consumers directly from Rely Innovations, Inc. ("Rely," "we," "us," or "our") through RelySafety.com or any other Rely-operated online store that expressly links to these Terms (the "Store"). These Terms do not apply to purchases made through another retailer, distributor, marketplace seller, or other third party, or to purchases made for resale or under a commercial account. Those transactions are governed by the applicable seller's terms or Rely's commercial terms, as applicable.
To complete a purchase through the Store, you will be required to affirmatively agree to these Terms during checkout. By accepting these Terms and placing your order, you agree to be bound by the version presented at checkout. Your use of the Store is also subject to Rely's Terms of Use, and our Privacy Policy describes how we collect, use, and disclose personal information.
1. Eligibility and Consumer Use
You must be at least the age of majority in your state of residence and legally able to enter into a binding contract to place an order through the Store. The Store is intended for purchases by end users for personal, family, or household use. Purchases for resale, distribution, or another commercial purpose may instead be subject to Rely's applicable commercial terms.
2. Orders and Acceptance
Your order is an offer to purchase the products identified in the order. An automated order confirmation acknowledges that we received your order; it does not necessarily mean that Rely has accepted the order.
Rely may decline or cancel an order before acceptance for reasonable reasons, including product unavailability, payment or fraud-prevention issues, an obvious pricing or product-information error, quantity limitations, or shipping restrictions. An order is accepted when we send a shipment confirmation or otherwise expressly confirm acceptance. If we cancel an order after collecting payment, we will refund the amount collected for the canceled item or order.
3. Prices, Payment, and Taxes
The product price, any shipping charge, and applicable sales or other taxes will be displayed during checkout before you confirm your order. Accepted payment methods are those offered through the Store at checkout. You must provide a valid payment method and accurate billing information.
Prices and promotions may change for future purchases, but changes will not affect an order after it has been accepted. We may correct an obvious pricing or product-information error before accepting an order. If an affected order is canceled after payment has been collected, we will refund the amount collected for the canceled item or order.
4. Shipping and Delivery
Shipping methods, rates, order-processing information, estimated delivery times, destination limitations, and address requirements are described in Rely's Shipping & Returns Policy in effect when you place your order. That policy is incorporated into these Terms by reference. Any shipping charges and the full order total will be displayed before you confirm your order.
Rely currently ships direct consumer orders only to eligible U.S. destinations described in the Shipping & Returns Policy and does not offer international shipping through the Store. A valid street address may be required; the Store does not ship to P.O. Boxes or APO/FPO addresses.
Delivery and transit times are estimates and may be affected by carrier delays or circumstances outside Rely's reasonable control. If we cannot ship within the timeframe stated at the time of purchase, we will provide the notice, delay-consent opportunity, cancellation option, or refund required by applicable law.
5. Returns and Refunds
For products purchased directly through the Store, a return request must be made within 30 days after delivery. To qualify for an ordinary return, the product must be new, unused, and undamaged. Contact Rely customer support before sending any product back so that we can review the request and provide return instructions and the applicable return address.
For an ordinary consumer return, you are responsible for return shipping costs. We recommend using an insured, trackable shipping method and retaining the shipment receipt and tracking information. Rely is not responsible for a return shipment that is lost or damaged before we receive it. No restocking fee is charged for an eligible ordinary return.
Once an eligible returned product is received and inspected, Rely will issue the applicable product refund to the original payment method. Original outbound shipping charges are not refundable for an ordinary return, except where required by law. If the return results from an incorrect item shipped by Rely, shipping damage, or a potential product defect, contact customer support before returning the product because different instructions or shipping-cost treatment may apply.
Purchases made through another retailer, distributor, marketplace seller, or other third party are subject to that seller's return and refund policies and should be handled through that seller unless a product warranty claim is being made directly to Rely.
6. Product Warranties
Rely products may be covered by a separate written limited warranty. The warranty applicable to a particular product, including its coverage period, exclusions, and claim procedures, governs warranty claims for that product and is not expanded or modified by these Terms. Warranty information is supplied with the product and will also be made available to direct online purchasers before purchase, such as through the applicable product page or a clearly identified warranty link.
If you believe a product is defective, contact Rely customer support and have the product model and relevant purchase information available. A warranty claim is separate from an ordinary 30-day return request and will be handled according to the applicable written warranty.
Nothing in these Terms excludes or limits any implied warranty, statutory right, or other consumer remedy that cannot lawfully be excluded or limited under applicable law.
7. Product Information and Availability
We make reasonable efforts to display product descriptions, specifications, images, availability, and other Store information accurately. Minor differences in packaging or appearance may occur, and product availability may change. If a material error affects an order before acceptance, we may cancel the affected order and refund any amount collected for it.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Rely will not be liable for indirect, incidental, special, or consequential damages arising solely from the purchase transaction or a breach of these Terms. Nothing in these Terms limits or excludes liability or consumer rights that cannot lawfully be limited or excluded, including any rights or remedies that may apply to personal injury, product defects, gross negligence, willful misconduct, or other matters protected by applicable law.
9. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except that this choice of law will not deprive you of any mandatory consumer protection afforded by the law of your state of residence that cannot lawfully be waived.
Subject to applicable law, disputes arising from these Terms or a direct purchase from the Store will be brought in the state courts of Wisconsin or the United States District Court for the Western District of Wisconsin. This forum provision does not apply to the extent applicable law gives you a non-waivable right to bring a claim in another forum.
10. Changes to These Terms
Rely may update these Terms from time to time. The Terms that apply to a purchase are the version presented or made available to you when you submit the order. A later change to these Terms will not retroactively change the terms governing an order already accepted by Rely.
11. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Rely's failure to enforce a provision of these Terms does not waive Rely's right to enforce that provision later.
